By accessing the PLUGZZi app and website (“the Platform”) or utilizing any services offered through them, and by registering an account for such services, you acknowledge and agree to be bound by the legal obligations outlined in this agreement. This agreement, hereinafter referred to as the “Agreement,” establishes the terms and conditions governing your use of PLUGZZi SHPK’s service, collectively referred to as the “Service,” accessible through the PLUGZZi website and the mobile application known as the “PLUGZZi App.”
User acceptance of agreement
1.1. Your utilization of the Service is contingent upon compliance with this Agreement, as well as our privacy policy (“Privacy Policy”) and any additional usage rules (“Usage Policy”), both of which are available on the Platform.
1.2. By accessing and using the Service, you implicitly agree to abide by our Usage Policy and Privacy Policy, which are integral components of this Agreement.
Agreement modifications
2.1. We retain the right to modify the terms of this Agreement at our discretion, with such changes becoming effective upon posting the modified Agreement on the Platform.
2.2. Each instance of Platform or Service usage will be subject to the then-current version of this Agreement. Continued use of the Platform or Service after any modification indicates your acceptance of the terms in the current version of the Agreement.
User Qualification
3.1. You affirm and assure that:
(a) You are 18 years of age or older and possess the requisite mental and legal capacity to enter into this Agreement and utilize the Services.
(b) Any information you provide during your use of the Service is accurate, complete, and up-to-date.
(c) Your use of the Service complies with all applicable laws and regulations.
Registration rules and process
4.1. You affirm and assure that: (a) You will register with the Platform through a designated procedure to become a registered user. The information provided during the registration process is accurate and complete, and any changes to this information will be promptly communicated to us. (b) The user account (“Account”) created in the registration process is personal to you, and you may not use an account registered to anyone other than yourself. Account transfer to others is prohibited, and you may not enable or assist others in using the Service through your Account, except for those expressly authorized by us.
4.2. Following successful registration, you may commence using the Service through the Platform in accordance with this Agreement.
4.3. We retain the right to suspend, deny, or revoke your access to your Account, the Platform, and/or the Service at our sole discretion. In the event of suspension or denial, you have the option to file a User complaint following the procedures outlined in this Agreement.
Security
5.1. You bear the responsibility for safeguarding your PLUGZZi account, including login details and password(s). It is imperative to log out at the conclusion of each session on the Platform and follow the appropriate steps to exit. Any divulgence of your account information may render you accountable for resulting losses and consequences.
5.2. All actions and outcomes conducted under your account using PLUGZZi services are your responsibility. This includes instances where such actions cause harm to yourself, PLUGZZi SHPK, or a third party.
5.3. Promptly inform us through the Platform if you become aware of any unauthorized use of your account or any situation that may lead to theft or loss. Upon notification of unauthorized use, we will take reasonable steps to address the issue. but you acknowledge that doing so takes a reasonable amount of time, and it may not be immediate.
5.4. Your account is for your personal use only and may not be shared. You commit to: (a) Keep your account details private; (b) Safeguard the login verification code; (c) Refrain from transferring any part of your account to others; (d) Adhere to all applicable laws and the terms of this Agreement concerning your account.
Service usage
6.1. Using PLUGZZi Services:
6.1.1. Following registration, users must add payment details to the app. By selecting specific features in the PLUGZZi App, users can access and utilize the services.
6.1.2. Immediately after you retain a PLUGZZi Powerbank , carefully inspect it for any issues, and promptly report any problems through the PLUGZZi App or designated customer service channels. You have the amount of time indicated on usage policy and/or APP during renting process to return it back and not being charged.
6.1.3. You are solely responsible for using PLUGZZi services in circumstances where advised otherwise or when any issues are apparent.
6.1.4. Use PLUGZZi services reasonably and lawfully, refraining from damaging or restricting their use by others.
6.1.5. Return any items provided by PLUGZZi in the same condition as received; otherwise, you may be subject to additional charges.
6.1.6. Do not rent out or use PLUGZZi services for commercial purposes without explicit authorization.
6.1.7. End the usage period by following the designated procedures after each use.
6.1.8. Your use of any PLUGZZi service may be subject to specific time limitations or other restrictions, as outlined in the Platform.
6.1.9. PLUGZZi services are provided for convenience and intended for use by qualified individuals who agree to the terms outlined in this Agreement.
Pricing for Service Usage
7.1. The cost of using the PLUGZZi service varies and is subject to change based on your location. The most recent and current pricing details can always be found in the PLUGZZi App.
7.2. Service charges are displayed on the PLUGZZi App and are subject to change from time to time.
7.3. If you have a coupon or promo code for PLUGZZi services, you may utilize it following the user rules provided on the coupon.
7.4. Various payment options are provided for your convenience, available as and when each becomes accessible in your area: (a) An account with a valid debit or credit card or another approved payment method is required to use our services. Pricing details for PLUGZZi services can be found in the App, and we may adjust pricing as deemed necessary for our business. All payments are processed through a third-party payment processor based on your designated payment method.
7.5. If you dispute any charge on your payment card or account, contact us at support@plugzzi.com as soon as the dispute becomes known and provide us all the information that is needed to identify the disputed charge, such as date of Utilisation, time and all other information available to you.
7.6. Disagreements with charges must be communicated within 10 business days of the disputed charge. Refunds are offered for any issues with the provided services, and refund requests can be made through support@plugzzi.com.
7.7. If the necessary charge cannot be deducted due to insufficient funds or a blocked card, an invoice will be sent via text message, mail, and/or email. Failure to pay the invoice may result in legal action for debt collection.
7.8. Refunds, whether full or partial, will be returned through the original payment method. The processing of refunds is subject to the policies of the payment processor and may take a reasonable amount of time. Depending on your payment methot there may be up to 4.5% commision rettained by the sum of refund for the transaction occurred by payment processor. This is not a charge by PLUGZZi Shpk but a service being paid to the payment processor for the action occurred.
Ownership and Intellectual Property
8.1 Your acceptance of this Agreement and your status as a User only grants you access to the PLUGZZi Service in accordance with the terms specified herein. No other authorization, collaboration, partnership, or agency exists between you and PLUGZZi SHPK.
8.2 You recognize that all intellectual property rights pertaining to the Platform (including copyrights, trademarks, trade names, logos, source and object codes) and proprietary confidential information within the Platform are and shall remain the exclusive property of PLUGZZi SHPK or its licensors. This Agreement does not transfer any intellectual property rights to you. Without explicit written authorization, you may not use, modify, rent, sell, transmit, or violate the aforementioned intellectual property rights (such as reverse engineering, decompiling).
8.3 PLUGZZi’s name and logos are trademarks and trade names owned by PLUGZZi SHPK, and their duplication, imitation, or partial use without PLUGZZi SHPK’s prior written approval is prohibited. Additionally, all pages, text, graphics, images, button icons, and scripts on the Platform are owned by PLUGZZi SHPK, and any duplication, imitation, or partial use requires PLUGZZi SHPK’s prior written approval.
8.4 We grant you a limited, royalty-free, non-exclusive, personal, revocable, and non-transferable license to download and use the PLUGZZi App for your personal, non-commercial purposes, contingent upon your compliance with this Agreement.
8.5 You are solely responsible for all content, texts, and images (referred to as “User Content”) you upload, post, transmit, or share on the Platform. You may not provide User Content that you did not create or do not have permission to upload. By uploading User Content, you grant PLUGZZi SHPK an irrevocable, perpetual, non-exclusive, transferable, royalty-free license to use, copy, publicly perform, display, sublicense, distribute, modify, prepare derivative works, or incorporate User Content into other works for any purpose.
8.6 We may access, store, and use the information you provide in compliance with the Privacy Policy and your privacy settings. You grant PLUGZZi SHPK a royalty-free license to use such information during the applicable copyright protection period.
8.7 In protecting transaction confidential data, we utilize the most up-to-date technology, including the SSL protocol and PKI system. Payment card data is transmitted in a secure, cryptic form over a public network. The security of data during purchases is ensured by the payment card processor and our system does not have access to payment card data.
Indemnification
9.1. You agree to indemnify and hold PLUGZZi SHPK, its employees, and agents harmless from any liability arising from your use of any PLUGZZi Service or the Platform due to your acts, omissions, or negligence.
9.2. You further agree to indemnify PLUGZZi SHPK and its associated parties providing the Service, protecting them from all liabilities, claims, losses, damages, expenses, costs (including legal fees), debts, fines, penalties, and charges resulting from your misuse or inability to use the Platform, unauthorized access, or any prohibited action or inaction that disrupts the Platform or the Service.
9.3. If your conduct leads to PLUGZZi SHPK paying third-party claims, PLUGZZi SHPK may seek reimbursement from you for all incurred losses after undertaking monetary and other obligations to third parties.
Termination of Agreement
10.1 User Termination
(a) You can terminate this Agreement by notifying PLUGZZi SHPK via the Platform that you intend to cease using the Service and the Platform at any time.
(b) Termination is effective if you cease using the Service and the Platform and explicitly reject any changes to this Agreement before the changes take effect.
10.2 Termination initiated by PLUGZZi SHPK:
(a) PLUGZZi SHPK may terminate this Agreement if you breach any terms.
(b) Termination may result from non-payment of sums due within 7 days of the date due.
(c) Inactivity for 365 consecutive days or more may lead to termination.
(d) If your continued use of the Service or the Platform is deemed detrimental.
(e) Termination will occur if you reject changes to this Agreement.
10.3 Settlement after Termination:
(a) Upon termination, PLUGZZi SHPK retains the right to make claims against you for prior breaches or outstanding financial obligations.
User Conduct Disclaimer:
We do not control users’ conduct on the Platform and are not responsible for user posts. If you believe a user has violated terms, please contact us. We disclaim liability for user conduct or content.
Governing Law and Jurisdiction
These overarching Terms of Service regarding the utilization of PLUGZZi are subject to interpretation and enforcement in line with the laws of Albania. Exclusive jurisdiction for the resolution of any dispute between you and PLUGZZi lies with the competent courts in Albania.
